§ 1. DEFINITIONS
- Order Cancellation – a possibility to terminate the Sale Agreement or lack of acceptance to enter into such agreement for the reasons beyond the control of the Seller, set up in the Terms and Conditions; in the event of Order Cancellation, the Customer receives a notification of such cancellation with the justification of this action to the e-mail address given during the purchase process.
- Order Lead Time – time in which the order is completed and handed over to the carrier which will deliver the Order to the address given by the Customer; order lead time does not include delivery time.
- Working Days – mean weekdays from Monday till Friday (excluding days which are statutory free from work).
- Customer – an entity having full capacity to perform acts of law, who places an order in the Online Shop according to the Terms and Conditions, and to whose benefit the Seller renders electronic services.
- Consumer – Customer being a natural person, performing acts of law which are not in connection with their commercial or professional activity.
- Shopping Cart – integral part of the Online Shop and purchase system, in which the Customer approves Order details, that is type and quantity of selected items, delivery data, invoice data, payment method.
- Terms and Conditions – these Terms and Conditions of the Online Shop.
- Online Shop (Shop) – website accessible at [insert website], by using which the Customer may particularly place an Order for available Items.
- Item – product presented in the Online Shop, which may be the subject of a Sale Agreement.
- Sale Agreement – agreement of sale of an Item concluded in accordance with the Terms and Conditions between the Seller and the Customer, through the purchase system of the Shop.
- Order – statement of will of the Customer leading directly to the conclusion of Sale Agreement setting forth its important conditions.
§ 2. GENERAL RULES
- These Terms and Conditions set forth rules for usage of the Online Shop, particularly conditions of placing and modifying Orders, making payments and other rights and responsibilities of the Customer and the Seller.
- The Online Shop is engaged in retail sale of Items, particularly cat scratchers, via the Internet.
- These Terms and Conditions are accessible free of charge before concluding the agreement on the website of the Online Shop, and also, at a Customer’s demand, in such a way as to enable the Customer to obtain, replay, and save the Terms and Conditions.
- Getting acquainted with these Terms and Conditions and their acceptance is the condition of using the website and placing an Order in the Online Shop.
- Information contained in the Online Shop is not an offer within the meaning of the Civil Code but is an invitation to conclude an agreement.
- The Customer is forbidden to:
- deliver content which is forbidden by law, including content infringing personal rights and other rights of any third parties,
- act in a manner infringing the law or in order to evade the law,
- use the Online Shop in a manner disrupting its functioning or onerous to the Seller or other Customers.
- All agreements are concluded subject to the provisions of Polish law.
§ 3. PRODUCTS
Products available for purchase may differ from the images displayed on our website. Variations in color, texture, and wood patterns may occur due to factors such as lighting and the natural characteristics of the materials used. We strive to accurately represent our products; however, these unique attributes ensure that each item is one-of-a-kind. By purchasing our products, you acknowledge and accept that such variations may exist.
§ 4. ORDERS
- Electronic orders may be placed 24 hours a day, 7 days a week during the whole year, but they are processed during Working Days only.
- Orders may be placed by Customers, who:
- Do not need to have the status of a registered Online Shop User (no account creation is necessary).
- Customer creates an Order by adding Items to the Shopping Cart digitally. After going to ‘Checkout’, the Customer chooses the payment and delivery method and the delivery address for the Order.
- Customer may change the Order until the moment of clicking the ‘Pay Now’ button.
- Conclusion of a Sale Agreement takes place at the moment of sending an Order confirmation by the Seller to the Customer’s e-mail address.
- Order Lead Time takes between 2 and 10 Working Days, depending on availability and processing time.
§ 5. PRICES AND PAYMENTS
- Prices shown in the Online Shop include all taxes.
- Total sum of the Order, including delivery costs, is shown before placing the Order.
- The binding price is shown to the Customer in the Order summary at the moment of placing an Order with the Seller.
- Available payment methods:
- Electronic payments (through Stripe integration).
§ 6. DELIVERY
- Customer incurs delivery costs, which are added to the Order value in the Order summary.
- Orders are delivered to the address indicated in the Order Form.
- Orders within Poland take up to 10 Working Days, typically 2 days after processing is complete.
§ 7. WITHDRAWAL FROM THE AGREEMENT
- The Consumer may withdraw from the agreement without providing any reason within 14 days of receiving the Item(s).
- To initiate a return, the Customer must notify the Seller and return the Item(s) in an unchanged condition no later than within 14 days. Detailed instructions for returning items can be found in our Return Policy.
- The costs of returning the Item(s) are incurred by the Customer.
- The Seller reserves the right to withdraw from the agreement and cancel the order at any time in the case of unforeseen circumstances, including but not limited to:
- Errors in product pricing or information
- Stock shortages or unavailability
- Issues with payment processing
- Suspicion of fraudulent activity
- Any other reasons at the sole discretion of the Seller
- In the event of such withdrawal, the Customer will be notified, and any payments made will be refunded in full.
§ 8. COMPLAINTS
- If the Item(s) is not in accordance with the agreement, the Customer may demand free repair or replacement.
- The Seller will consider the complaint within 14 days.
§ 9. PROCESSING PERSONAL DATA
- Personal data indicated by the Customer are processed by the Seller in accordance with applicable laws.
- Detailed information is provided in the Privacy Policy available on the Online Shop’s website.
§ 10. AMENDMENTS TO THE TERMS AND CONDITIONS
- The Seller reserves the right to amend these Terms and Conditions. Any amendments will be published on the website.
- Customers who placed orders before the amendment will be subject to the Terms and Conditions in force at the time of placing the Order.
§ 11. FINAL PROVISIONS
- In matters not covered by these Terms and Conditions, the provisions of Polish law, particularly the Civil Code, shall apply.
- The Terms and Conditions shall be governed by and construed in accordance with Polish law.
